PERSONAL DATA PROTECTION

Personal Data Protection Notice

This Personal Data Protection Notice is prepared under the Law on the Protection of Personal Data No. 6698 (KVKK) and explains:

1. What types of personal data are collected via www.aktifyay.com.tr (“Site”), how these data are used, and with whom they may be shared,
2. Your rights regarding your personal data processed by the Site and how you can exercise these rights,
3. How you can manage your preferences regarding receiving electronic commercial communications.

1. Purpose of Data Collection

To provide better service to our members, manage and complete order processes, communicate with you, provide information about products, services, campaigns, and promotions, analyze shopping preferences, trends, and statistical data, and ensure Site security, we may process the following personal data:

• Name, surname, email address, phone number, gender, date of birth, national ID number, tax ID number, personal interests, billing and shipping addresses
• Information provided through social media accounts (with consent)
• Non-personal aggregate statistical data such as Site visit frequency, order times, visited product pages, and order statistics

These data are processed only for purposes defined under KVKK, with your explicit consent, for contractual obligations, or for legitimate interests without harming your fundamental rights and freedoms.

2. Credit Card and Payment Information

• When paying with a credit card, your card number, expiration date, and CVV2 are shared only with the relevant bank.
• Credit/debit card information is not stored on our systems.

3. Store and Customer Records

• Providing your contact information in our stores may result in collection of personal data during interactions with our staff.
• This data may be used for identity verification, personalized campaigns and promotions, marketing communications, and tracking return/exchange processes.
• Terminated membership accounts may be anonymized; anonymized records no longer constitute personal data and cannot be subject to any claim.

4. Third-Party Data Sharing

• Personal data may be shared with third parties (shipping, call centers, database services, etc.) for providing services.
• Data may be shared with government authorities when legally required.
• Outside of these circumstances, personal data will not be shared for commercial purposes.

5. Your Rights under KVKK

Under Article 11 of KVKK, you have the following rights regarding your personal data:

1. To learn whether your personal data is being processed
2. To request information on processing activities
3. To learn the purposes of data processing
4. To know if your data has been transferred to domestic or foreign third parties
5. To request correction of incomplete or inaccurate data
6. To request deletion or destruction of data if processing reasons no longer exist or legal grounds are lacking
7. To ensure that the Company or authorized third parties respect your rights
8. To object to negative consequences arising from automated processing
9. To claim compensation for damages resulting from unlawful processing

6. Data Security

• The Site takes all necessary technical, administrative, and physical measures to prevent unauthorized access, loss, misuse, disclosure, alteration, or destruction of personal data.
• In case of a security breach, you and the Personal Data Protection Board will be notified immediately, and corrective measures will be taken.

7. Changes to the Notice

• www.aktifyay.com.tr may update this notice at any time.
• Updated provisions become effective as soon as they are published on the Site, and members will be informed accordingly.
